1. Identification of Vacation Home: Landlord is authorized to rent the vacation home located at the above address which will be referred to in this rental agreement as the "Rental Property." The rental property is intended for residential use only.

2. Subject to the terms of this Agreement, Tenant agrees to rent the Rental Property from Landlord for residential use, including furniture, kitchen appliances including cutlery, linens and towels. Rentals may also include parking space in a garage or a private parking space.

3. The rental period begins on the agreed date at the earliest at 4:00 p.m. and ends on the agreed date at the latest at 11:00 a.m., unless otherwise agreed in writing. Under no circumstances is the tenant entitled to stay in the rental property when the rental period expires.

4. If the tenant is unable to use the rental property for the entire booked period, the tenant is still responsible for paying the rent according to the terms of this agreement.

5. The tenant must pay the landlord the total rent before entering the property. Air conditioning is not included but operates via a prepaid A/C meter. Prepaid cards can be purchased from the Landlord upon arrival.

6. The rental property must only be used as a private residence for the tenant. Tenant(s) and guests or invitees may not use the rental property for any illegal activity or nuisance, including, but not limited to, disruptive parties and/or music, nuisance to neighbors, possession or use of illegal substances, or damage to property. The tenant(s) shall be responsible to the landlord for the actions of the tenants or its guests.

7. No pets of any kind are allowed without the prior written consent of the landlord. The landlord can refuse consent for any reason and require a deposit for pets in the amount of 500 euros.

8. Smoking of any type of tobacco or similar substances is not permitted indoors.

9. The tenant is not permitted to make any repairs or changes to the rental property.

10. The tenant has access to two (2) sets of keys. Keys to the rental property belong to the landlord and must be returned by the tenant to the landlord at the end of the lease. Tenant(s) may not change or alternate any locks to the rental property, nor make key copies. In case of lost keys, a cost of 30 euros is added, which must be paid

11. If Tenant fails to comply with the terms of this Agreement, this Agreement may be terminated by Landlord with appropriate notice to Tenant and by procedures required by law.

12. The rental property may under no circumstances be rented out or lent to anyone else without prior written approval from the landlord.

13. Upon arrival at the rental property, the tenant pays the landlord a damage deposit of 300-500 Euro depending on the rental property. No later than 1 week after the Tenant has vacated the Rental Property, returned keys to the Landlord and provided a bank account number, the Landlord will refund the security deposit to the Tenant, less any amounts due from the Tenant to the Landlord for any of the following items: unpaid rent, repair or cleaning costs beyond normal wear and tear on the rental property. The landlord will provide the tenants with an itemized written statement of any deductions made from the security deposit.

14. The tenant is responsible for keeping the rental property clean, sanitary and in good condition. The tenant) must immediately notify the landlord of dangerous conditions or defects discovered in the rental property, or which arose during the term of the agreement, regardless of whether they are existing, caused by tenants, minor children (if any), or visitors, and unintentionally or deliberately caused.

15. Due to national rules and regulations, the tenant must provide the landlord with the name and identification number of all guests over the age of 16. This must be given to the landlord before arrival. The landlord is obliged to report this to the Guardia Civil according to the tourist rental laws in the area.

16. This Agreement will be interpreted and governed by the laws of Spain and the venue for any dispute regarding this Agreement will be in the County of Murcia. In the event of a dispute between the parties arising under this agreement, the parties shall first attempt to resolve the dispute personally and in the best way possible to reach a solution. Alternatively, the dispute may be resolved in court.

17. If any part of this agreement is held to be illegal, void or unenforceable under the laws of Spain or any other court of competent jurisdiction, that part of the agreement will be considered invalid only in that particular point without invalidating the entire contract.

18. No waiver of any condition or breach/deviation of this Agreement will be binding on either party unless the Agreement is in writing signed by both parties. The failure of either party to enforce any provision of this Agreement shall not affect the validity of either party's right to enforce any provision at any time and thereafter.

19. This Agreement, including all appendices (if any), constitutes the entire agreement between the parties superseding all prior negotiations, agreements and undertakings, whether written or oral with respect to this Tenant and Leasehold. All amendments to this Agreement must be in writing and must be signed by each party. There are no interpretations, representations or warranties other than those expressly stated herein and no rights are granted other than those expressly stated herein.
